Terms and Conditions of the kahaus.com online store

§1 General provisions

The online store available at kahaus.com (hereinafter: the "Store") is operated by VARCH Spółka z ograniczoną odpowiedzialnością, with its registered office in Niepołomice, ul. Pociągów Pancernych 1D, 32-005 Niepołomice, Lesser Poland Voivodeship, Poland, entered in the National Court Register kept by the District Court for Kraków-Śródmieście in Kraków, XI Commercial Division of the National Court Register, under KRS number 0000685918, NIP 6793152735, REGON 367770370, share capital PLN 5,000.00 (hereinafter: the "Seller").

The company is represented by the Management Board — each member of the Management Board individually.

These Terms and Conditions set out the rules for using the Store, placing orders, concluding sales contracts, payment, delivery, withdrawal from the contract and complaints.

§2 Definitions

Customer — a natural person, legal person or organisational unit without legal personality making purchases in the Store.

Consumer — a Customer who is a natural person making a purchase not directly related to their business or professional activity.

Order — a declaration of intent by the Customer aimed at concluding a contract for the sale of products offered in the Store.

Seller — VARCH Sp. z o.o., details as in §1.

§3 Placing orders

Orders may be placed 24 hours a day via the Store's website.

Placing an order requires providing correct and current data necessary to process the order (first name, surname, delivery address, e-mail address, telephone number).

After placing an order, the Customer receives confirmation of its acceptance at the e-mail address provided.

The sales contract is concluded when the Seller confirms acceptance of the order.

§4 Prices and payment

All prices shown in the Store are gross prices (they include VAT) and are expressed in the currency displayed with the product.

The Customer may pay for the order using the payment methods available in the Store (including payment cards, BLIK, Przelewy24 and others indicated during the purchase process).

The order is processed once the payment has been credited to the Seller's account.

§5 Delivery

Orders are processed in accordance with the Shipping Policy available in the Store.

Order preparation takes 1-2 business days; delivery time depends on the destination country.

Shipping within Poland is free of charge. For the remaining European Union countries the shipping cost is EUR 5.99 per parcel, and orders from EUR 20 are shipped free of charge.

Parcels are delivered by the courier DPD from the territory of Poland.

§6 Right of withdrawal

The Consumer has the right to withdraw from a distance contract within 30 days without giving a reason, in accordance with the Return and Refund Policy available in the Store. This period is longer than the statutory minimum of 14 days and is granted voluntarily by the Seller.

The returned goods must be unused and in their original, undamaged packaging.

§7 Complaints

The Seller is liable to the Consumer for the lack of conformity of the goods with the contract on the terms set out in the Polish Consumer Rights Act.

Complaints may be submitted by e-mail to shop@kahaus.com, stating the order number and a description of the non-conformity.

The Seller will respond to a complaint within 14 days of receiving it.

§8 Personal data

The rules for processing Customers' personal data are set out in the Privacy Policy available in the Store.

§9 Final provisions

In matters not regulated by these Terms and Conditions, Polish law shall apply, in particular the Civil Code and the Consumer Rights Act.

The Seller reserves the right to amend these Terms and Conditions for important reasons (e.g. changes in legislation, a change in the scope of business). Amendments enter into force upon publication on the Store's website.

Any disputes shall be settled by the court having jurisdiction under the applicable regulations, and the Consumer may use out-of-court methods of handling complaints and pursuing claims.
